Title: Lost into the ether of the internet
Post by: Monketh on February 25, 2005, 03:45:33 am
I have a question: Has anybody here saved any of anyones else\'s images on their disks?  As you all well know, the internet is constantly creating and losing data.  Which sometimes means the loss of valuable things.  I\'m just wondering if some of those image-not-found links might be replaceble.  Missing Kintall images (WoW has thumbnails, but that\'s it) in particular are of interest, though anything missing from the fanart forum would be absolutely grand.

I think I have a few floating around my hdd.  I hope it\'s legal to do this.  :P

None of these are mine, I did not create them.

I want to say one of the mercenary guild\'s guys did this.  [Edit] But my blurred memory has failed me and kwartz is the artist.

I do not object to having my artwork saved in a harddrive, personally. In fact, I know a person who has used one of my images as her default desktop wallpaper.

I consider it illegal, though, for someone to alter my images in one way or another without my explicit consent (Which will usually be a \"no\" ), to claim authorship, or to distribute without mentioning the artwork is mine. As unlikely it is to happen, if publishing and earnings enter the equation (and I am excluded ;)), I will not be very happy.

Anyway, I do have that image in my hard drive. I\'ve meant to edit it for months, but something always came up.

well being quite proud of my ability to sidestep the law as much as one can whenever possible :) i\'ll interject.. unless you have it copyrighted and then they (the person who changes the image) changes and then calls it their own, uses it widespread or uses it for profit then its legal :/

If they changed it for thier own wallpaper or something then thiers not much if anything you could do XD.. and thats even if you HAVE a copyright.. if its not copyrighted then as far as i know anybody can use it for anything O.o

EDIT i may be wrong feel free to correct

Sidenote: its said once it data is posted on the internet its NEVER EVER lost.. somebody has it or its in cache SOMEWHERE but it will always exist for the most part... thats kinda scary :P

I know of a certain artist that managed to forbid people from making forum avatars out of his artwork, since modifying the images without permission qualified as \"tampering\".

I am not particularly certain if lack of profit or personal usage is a valid excuse when intellectual property is violated.

In fact, I have been informed that even editting a copyrighted music file just a little bit (using any audio editting tool such as Cool Edit or Sound Forge) without permission is illegal.

Do not get me wrong. I doubtfully would press suit should I discover a stranger has altered one of my images for personal use. But I would definitely make a public claim saying the original is my work and that said individual has tampered it without consent.

ahhhh well  a tampering charge may stick if the image gets to more then a few people.. i thought we where just talking about editing a image for your own use :)

i still thinks its amazing how i proved my theory. i looked up images that had \"dissapeared\" (and that i missed now that i had read this) about 5 years ago. and alas to my amazingment those zombies of the internet had risen again! i think its awsome how once posted on the interweb a thought or file never dies completely

Intellectual Property surely is a double-edged sword. It must find a sensible balance between the interests of the creator and the interests of the society as a whole. For the creator, obviously it would be best to totally restrict everything, just like the RIAA is attempting to do. (DMCA, anyone?)

For society as a whole, it is best to have no restrictions at all, because then creativity of others isn\'t hampered, so that the most benefit can be derived from the original work.

Therefore, it is uaually legal to modify and do whatever you please with anything as long as it\'s for personal use. Personal use usually includes not only desktop wallpapers, but also the usual sharing with friends. Real ones, not the ones on the other end of the world that just happen to connect to your emule server.

Avatars and signatures are a bit of a problem, because the potential is there that the work gets distributed to many people. However, usually the avatar and signature images are very small and only excerpts, so that they are quite unusable for anything except their original use, so they don\'t do much damage, if at all.

The same is true for audio files: excerpts that are of insignificant duration compared to the entire work are AFAIK legal.

Furthermore, modifications and derivative works are always legal if they are made for parody purposes. That\'s because parody is an extremely important part of free speech, and as such rightfully is protected.

Because society has so much to lose, people using any form of Intellectual Property need to be very careful not to overuse the rights that were granted to them by society, because, as the RIAA and Software Patents (http://swpat.ffii.org) show, society will, due to the immense damage stemming from it, only tolerate such abuse to a certain extent, which is likely to result in a severe reduction of those rights in the long run. Therefore, it is in the IP owners own best interest to use common sense and not restrict fair use, as is for the society to not abuse the it\'s freedom.

Not everything, but anything that gets at least somewhat popular. Newsgroup archives also are giant libraries, because AFAIK some people save every single message that ever was posted. That and the wayback machine, which stores websites. http://www.oldversion.com stores program files.

This is quite important, because it will give historians in the far future a really good understanding of what our society was. Also, it will preserve every dumb thing that you say on the net for your personal embarrassment. :P
