Theft

I read in the forums that there will be no PK\'ing.
But what if someone steals something from me or pickpockets me, and I catch him/her in the act? Can I punish this person (i.e. kill that person), or is that impossible because no PK\'ing is allowed?
If I won\'t be able to kill this person, thieves are able to steal unpunished.  X(

There will be PK\'ing, but only in limited areas. And I\'m sure that if you can\'t smack up the thief, he wont be able to take your stuff in the first place.
