FS#4221 - missing Terms of Service
there aren’t any terms of service on the website and consistently the user doesn’t have to agree to them at any point.
this is a big issue in my opinion as the user isn’t strictly bound to such terms and therefore cannot be accordingly punished in case he’s causing really bad issues.
Isn't this covered in the EULA you click accept to when installing?
IANAL, but I know that in my country an EULA is not binding. If the user decides to only exercise their rights as granted in my country by default, and not any additional rights that may be granted in the EULA, then the user is also only bound to the restrictions that are applied by default here, and can ignore any restrictions added in the EULA.
I don't know if an EULA can at all refer to anything besides the software package, anyway, so a separate ToS for website and game might be better.
also a user may not agree to the EULA at all because he just compiled the client himself and got the art via the updater.
