I was doing a little googling when I found this site called Planeshift Software

Did anyone else see this?

Can they use the PS name ?

I'm no law student, so it's quite possible my understanding of US trademmark laws are not entirely correct, but the way I think I understand things, is:  Typically, it is fine to share names with another company/product as long as the products/companies are not similar in nature.  The bigger the company, however, the more they can say, "don't use our name anywhere".  Which is why you will find 1 and probably only 1 microsoft.  But also, as example, I work for a copany called Heartland, a medical transcriptionist company, we're on the 6th floor of the building, and on the second floor of the bulding is another company by the name Heartland, but they deal with taxes. 

It boils down to how much confusion the judge preciding over the case (as you would have to take it to court to have the other company stop using your name and provide prof you were using it first.) thinks there will be if two companies/products share names.

Theres more to it than that, but I think thats the basics of it anyways.

It really gets fun when one company holds trademark to a name, but then another company uses it anyways.  Case in point. Cisco owns the name iPhone.  Didn't stop Apple from calling thier new gaget by that name.  I think that battle is still in the courts though.  *shurgs*

This reminds me of a case a few years back. A guy called Mike Rowe (17) decided to have a laugh with his personal website so registered the name www.mikerowesoft.com. Obviously M$ did not take kindly to this and demanded he hand over the domain name to them. He refused, demanded compensation and M$ being the kind and generous company that we all know and love offered him 10USD from their tiny yearly turnover. He refused and demanded 10,000USD ;D

In the end the kid decided to settle for an Xbox and a load of other M$ stuff.

I believe PlaneShift as a name is trademarked and belongs to Atomic Blue Corporation (the non-profit organization that owns the game).

In any event, if two owners of a trademarked label/name so on decide they have no quarrel with each other, even though the name of their products/companies may be somewhat ambiguous, then... there is no quarrel. Besides, our PS has nothing similar to what those guys offer. So I guess it's just a funny coincidence and nothing more. :)

Added: If there is something I wouldn't mind to see being patented by M$, it would be the infamous Blue Screen of Death.

If we seek for something that makes Windows unique, that thing is it.  ;D
